GENERAL TERMS AND CONDITIONS OF SALE

Clause No. 1: Purpose

The general terms and conditions of sale described below set out the rights and obligations of LOS PISTOLEROS SARL and its customer in connection with the sale of the following goods: LOS PISTOLEROS ICE CREAM STICKS. Any service provided by LOS PISTOLEROS SARL therefore implies the buyer’s full and unconditional acceptance of these general terms and conditions of sale.

he prices of the goods sold are those in force on the day the order is placed. They are stated in euros and calculated excluding taxes. Consequently, VAT and shipping costs applicable on the day of the order will be added. LOS PISTOLEROS SARL reserves the right to change its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Les prix des marchandises vendues sont ceux en vigueur au jour de la prise de commande. Ils sont libellés en euros et calculés hors taxes. Par voie de conséquence, ils seront majorés du taux de TVA et des frais de transport applicables au jour de la commande.
La SARL LOS PISTOLEROS s’accorde le droit de modifier ses tarifs à tout moment. Toutefois, elle s’engage à facturer les marchandises commandées aux prix indiqués lors de l’enregistrement de la commande.

Clause No. 3: Discounts and rebates

The proposed prices include any discounts and rebates that LOS PISTOLEROS SARL may grant, depending on its results or on the buyer’s assumption of responsibility for certain services.

No discount will be granted for early payment

Clause No. 5: Payment terms

Orders are paid for via online payment on the website.

Clause No. 6: Delivery

Delivery is carried out:

  • or at the location indicated by the buyer on the order form.

The delivery time indicated when the order is registered is given for information purposes only and is in no way guaranteed.

Consequently, any reasonable delay in the delivery of the products shall not entitle the buyer to:

  • the award of damages;
  • cancellation of the order.

In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the delivery note upon receipt of said goods. These reservations must also be confirmed in writing within five days of delivery by registered letter with acknowledgement of receipt.

Free shipping is granted by LOS PISTOLEROS SARL to its customer from one pallet onwards.

Clause No. 7: Force majeure

LOS PISTOLEROS SARL shall not be held liable if the failure to perform or delay in performing any of its obligations described in these general terms and conditions of sale results from an event of force majeure. For this purpose, force majeure means any external event that is unforeseeable and irresistible within the meaning of Article 1148 of the French Civil Code.

Clause No. 8: Competent court

Any dispute relating to the interpretation and performance of these general terms and conditions of sale is subject to French law.

Failing an amicable settlement, the dispute shall be brought before the Cannes Commercial Court.
